Court Sides With San Luis Obispo County in Hemp Suit

A group of hemp farmers have lost a legal battle against the County of San Luis Obispo over an ordinance that they say constitutes a de facto ban on industrial hemp.

Two months ago, the San Luis Obispo County Supervisors passed an ordinance requiring a parcel of at least 400 acres with a 2,000-foot setback for hemp cultivation. The practical result was to make industrial hemp cultivation nearly impossible in the county — a move critics say was designed to placate winemakers in the region.

The Coalition for Agricultural Rights sued San Luis Obispo County. But the court has now ruled against the plaintiffs in their attempt to block the rules from being implemented.
